JDay Apps, LLC (“we”, “us”) is committed to respecting and being transparent about how we use our users’ (“you”, “your”) data and personal information. This policy will describe the data we collect, what we do with it, and where it might go. We encourage you to read this document carefully and be sure you understand it. By using our website or application (our “Services”, our “mobile application”), you accept the terms, conditions and practices contained in this document.

The Cheers mobile application is designed to be driven mainly by user content, particularly drink recipes you share with the rest of the world through Cheers. User content also contains photos of users, locations, drinks or all three plus comments or other data posted by users of our Services (collectively, “User Content”). We will make suggestions and help you find new drinks that may interest you. Keeping that in mind, there is a relatively small amount of personal information that is needed to achieve that goal. We ask for as little personal information as possible, and except for the limited circumstances outlined herein, we will never share any information without your permission. A detailed description of that information follows.


Information We Collect

For an individual user, the following information will be provided to us directly by you. You may manually type this in when creating a Cheers account, or authorize us to pull your information from your Facebook, Twitter, or Google+ account:


  • User name — this is required to create an account.
  • Password — this is required to create an account. We recommend something unique from other accounts that may be associated with your user name or email address, but rest assured that we take the most secure precautions available to keep this secret, even in the unlikely event of a data breach.
  • Email address — this is required to ensure a single account per user, and to contact you with important updates, such as material changes to our Terms of Service, this Privacy Policy, and an occasional newsletter should you choose to opt in.
  • First and last name — this is required to create an account, and at this time will not be publicly shared within our mobile application unless you choose to do so.
  • Gender — the gender with which you most closely identify is required to create an account, but not shared publicly. The main purpose for this information is to observe trends and aggregate non-personally identifiable data and be able to make drink recommendations.
  • Birthday — required to create an account, but not shared publicly in any way. We may aggregate data based on age ranges in order to observe trends and aggregate data to make drink recommendations.
  • City and/or State — you may provide the city and/or state or province in which you reside as part of your user profile.
  • Profile Picture — a photo you supply directly from your camera or photo album, or authorize from your existing profile upon sign in using Facebook, Twitter, or Google+.
  • Cheers Content — any drink recipes, photos, comments, or other submitted content you post during your use of our Services.
  • Service-related email communication — examples could be account verification, changes to service or terms, or security notices. You cannot opt out of these communications.

  • If the user is a bar, restaurant, or other business entity, we collect:


  • User Name — this is required to create an account.
  • Password — this is required to create an account. We recommend something unique from other accounts that may be associated with your user name or email address, but rest assured that we take the most secure precautions available to keep this secret, even in the unlikely event of a data breach.
  • Email address — this is required to ensure a single account per user, and to contact you with important updates, such as material changes to our Terms of Service, this Privacy Policy, and an occasional newsletter should you choose to opt in.
  • Bar/Restaurant/Business name — this is the publicly available name of your business, and it will be associated with your user name within our application.
  • Bar address — the physical location at which your bar, restaurant, or establishment resides.
  • Profile Picture — a photo you supply directly from your camera or photo album, showing the view you wish to present for your bar, restaurant, or establishment’s profile.
  • Cheers Content — any drink recipes, photos, comments, or other submitted content you post during your use of our Services.
  • Service-related email communication — examples could be account verification, changes to service or terms, or security notices. You cannot opt out of these communications.

Children's Guidelines

This website is directed at adults, not children under the age of 13. We do not seek to collect online contact information or distribute to third parties any personally identifiable information from children, or entice children to divulge information to us.


Information You Choose to Share

Any information or User Content you share using our Services becomes available to the public. This information or User Content may be searchable by other users of our Services, and may be re-shared by other users of our Services.


Analytics and Logging Information

We may use third party analytics tools to measure our traffic and usage trends within our Services. These tools collect information sent from your mobile device to our Services for the purpose of improving those Services. This information is aggregated with that of other users and is not used for the purpose of identifying any particular user.


We may collect an identifier that uniquely identifies your mobile device. We may use this device identifier to provide information to you or to other parties for the purpose of delivering personalized content or ads. This means personalized to your device and it’s operating system, software, and activity within our Services.


We may log certain information from requests made from your device to our Services, including IP address and the requested information. Additionally, we may track which of our emails sent to you are opened, and which links you click within them. Again, this information is collected for the purpose of improving our Services to you.


Location Data

One of the coolest features of our Services involves collecting and aggregating popular trends in our data with regard to our users’ locations. We cannot use your location unless you explicitly give us permission within our mobile application. The application will prompt you, asking for permission, before we try to access it for the first time. If you disable the use of your location, some features of our Services will not be available to you.


Using your Information

We may use information we receive to:


  • Have information such as favorites readily available upon sign in
  • Remember information to keep you signed in between sessions until you decide to log out
  • Provide personalized content or suggestions to you and other users, which could include drink recommendations, marketing, or advertisements
  • Monitor, test, and improve the quality of our Services
  • Develop and test new products or features
  • Monitor the total number of users, traffic/volume, or demographic data

Note about using your location data: When we collect your location, we receive it as a set of latitude and longitude coordinates with varying degrees of accuracy depending on the quality of your connection to a wifi network or cellular network. This location is only collected by us at a particular point in time, and never recorded continuously over any period of time. For example, you may search within our mobile application for the closest location that has particular drink, or where you might find the best drink in the city you are currently in (say, if you are visiting). We may also use your city, state, or regional data to come up with trends for that particular region.


Sharing your Information

We will not rent or sell your information to third parties outside JDay Apps, LLC without your consent, except as noted in this Policy.


Parties with whom we may share your information:

Any User Content you post or share within our Services is visible by other users of our Services. These users may or may not have registered accounts.


We may share your information with third parties that help us provide our Services. For example, these services may include marketing, ad tracking, analytics, or supporting our Service’s functionality. This information will generally be shared in a way that is not personally identifiable, by either removing personal information or aggregating User Content information. If we do share any of your personal information with one of our service providers, such as an email address, that service provider will not be permitted to further share or use your information for any other purpose.


By using our services, you consent to having your personal information and User Content transferred to and processed in the United States or any other country in which we, our affiliates, or service providers maintain facilities.


We may disclose your personal information in response to subpoenas, court orders, or other legal or law enforcement demands if we believe in good faith that the request is required by law. We may also disclose this information if we believe in good faith that such a disclosure is necessary to prevent fraud, other illegal activity, bodily harm to others, or to protect ourselves or our users from violations of our Terms of Service.


In the event of a corporate transaction such as a merger, sale, or acquisition of a significant portion of our business, we may transfer your information to the new owner in order to keep our Services operational. In such a case, the buyer or transferee must honor the Privacy Policy in effect at the time of that transaction.


Storing your Information

Your information collected through our Services may be stored and processed in the United States or any other country in which JDay Apps, LLC, its affiliates, or service providers maintain facilities.


We take commercially reasonable security measures to safeguard your personal information from unauthorized access or disclosure. However, no system can be guaranteed to be completely secure. We do not promise, and you should not expect that your personal information will always remain secure from access, disclosure, alteration, or destruction. You can help by using common sense privacy practices, such as maintaining the secrecy of your account and password and choosing a unique and secure password to protect your account.


Deleting Your Account

Users may deactivate or delete their accounts at any time by contacting us at accounts@cheersmobileapp.com. If you delete your account, we will remove your personal information from our systems within a commercially reasonable amount of time. However, any User Content you have shared will remain available within our Services or other third party services with which your User Content may have been shared by you or others.


Changes to this Policy

We reserve the right to change or amend this Privacy Policy at any time. If changes to this policy are deemed material by us, we will contact you via email with notice of these changes before they take effect.
